The Upper Tribunal’s judgment was handed down on 11 February 2021. It held that, as the likelihood of removing AM to Belarus was remote, continuing to refuse to grant AM leave to remain would be a violation of his right under article 8 of the European Convention on Human Rights. However, as the refusal of the Belarussian authorities to allow AM to enter Belarus was because of AM’s persistent failure to tell the truth as to his identity, he was not stateless. On 13 July 2018, AM applied to reinstate the judicial review proceedings which had previously been stayed. He also applied to add a second ground challenging the refusal to grant him leave to remain as a stateless person.

Much of what has happened was caused by sudden sparks and by Lukashenko’s mistakes. But there are long-term trends that are dissolving old stereotypes about Belarus. It is often ignored because it is somehow not a ‘real’ country; or diminished because it is pro-Russian; or, to use Friedrich Engels’ meaningless cliché, Belarusians are considered a ‘non-historical people’. If you plan to repatriate the person who died to the UK, you may require their passport to do this. In these circumstances, you should cancel the passport after they have been repatriated. The Belarusian furniture industry is the backbone of Lukashenko’s regime. So why hasn’t the EU sanctioned it yet?

It is very important to check if the person who died had insurance. If they had insurance, contact the insurance company as soon as possible.
